Mike Mukula has been released today after the Anti-Corruption Court clearing him of embezzling Shs210 million from the Gavi Fund.
Justice David Wangutusi ruled on Tuesday that that trial Chief magistrate Irene Akankwasa, who sent Capt. Mukula to prison did not scrutinise the evidence produced in court well .
Justice Wangutusi added that the charge imposed on Mukula was not proved to the degree of certainty.
In January this year ,Chief magistrate Irene Akankwasa sentenced Mike Mukula to four years imprisonment after finding him guilty of embezzling Shs210 million from the Gavi Fund,
Mukula was found guilty of the charges despite claiming he returned sh210m to the Central Bank while the remaining money, sh54m he claimed was asked for by the First Lady, Janet Museveni and her secretary, Margaret Karabo signed for the money which she received.
Chief Magistrate Irene Akankwasa sentenced Mukula after prosecution proved that Mukula received the money.
The Former State Health Minister however appealed against the sentence where his lawyers argued that trial Magistrate Irene Akankwasa erred in law when she believed the prosecution case before hearing his case.
Addressing the press after his release, praised President Yoweri Museveni, Teso elders, his wife Gladys Mukula, children, relatives, friends for being supportive during his stay at Luzira.
“I have learnt so many things at Luzira. I am very strong. My back has not been broken. I am glad God has given me this golden opportunity to be with you,” said Mukula.
