The hearing of the murder case of Assistant Inspector of Police John Michael Ariong was on Tuesday halted .
Tue Buganda Road Court Chief Magistrate, Eleanor Mary Khainza halted the hearing of a case involving the former FDC President Kizza Besigye and the Kampala Lord Mayor Erias Lukwago arguing that the trial will proceed until the Constitutional Court pronounces itself on a petition the accused filed challenging the legality of Sections 56 to 64 of the Penal Code Act, under which they are charged.
“This court has agreed to stay this trial because it concurs with the argument of the accused that some sections they complained about put into question the constitutionality of the provisions under which they are charged,” Khainza stated on Tuesday
Assistant Inspector of Police Ariongo John Bosco, a 48 year old officer with 26 years of service to the Police Force died last year after he was hit by a rock to his head.
The murdered officer had been deployed as part of an operation to ensure the maintenance of public order during an alleged illegal procession led by Dr Kizza Besigye.Other opposition officials were part of the procession that day.
