A City lawyer identified as Davis Wesley Turyasingura has challenged the legality of the anti –corruption court; if his petition is judged in the favour of his argument by the Constitutional Court, the decisions and trials conducted by the Kololo based Court could be doomed.
The lawyer petitioned the Constitutional Court claiming that the Anti-Corruption Division of the High Court Practice Directions (2009) and instrument which establishes the court is unconstitutional.
He says ,the appointment to and exercise of judicial duties by the Chief Magistrate and Grade One Magistrate as designed in the Anti-Corruption Division offends the constitutional composition and structure of the High Court which is not a designated magisterial area.
Through his Attorneys ,Muwema and Mugerwa Advocates ,Mr Turyasingura wants the constitutional court to nullify the criminal trials decisions and acquittals conducted by the Magistrates in the Anti Corruption Court Division of the High Court.
