Luwero woman MP ,Brenda Nabukenya has vowed to appeal against the Nakawa court’s ruling on summoning the Chief of Defense Forces ,Gen.Aronda Nyakairima to answer for the statements he made about the army take over .
Nabukenya was accompanied by her lawyers; Mr Julius Galisonga and Mr Caleb Alaka at the Nakawa Chief Magistrate’s Court on Tuesday where Chief Magistrate Joyce Kabagye dismissed the application for the summons, saying the complaint on oath, the charge sheet plus the criminal summons prepared were not competent before court.
“Since there is no local set up as required by law, then the complaint is incompetent. The complaint should have been accompanied by a letter from the local village chief,” said Ms Kabagye, adding that it appeared that the prosecutors are the investigators, which is against the principles of natural justice.
Nabukenya however described the court ruling as misinterpretation of laws because she said their is still a treasonable case against General Nyakairima.
“I still believe there is a case and that is why my lawyers have asked court for the records to appeal,” Nabukenya told journalists after the ruling.
